We take copyright very seriously. However, some people clearly don’t understand how simple international copyright law is.
So, we’ll make it simple for you. Under the principles of the Berne Convention everything we personally have written or the photographs we have taken are ours. They belong to us, pure and simple, and NOBODY has the right to use them without our permission.
So, do not do it.
If you would like our permission to use our words or images without paying for them, ask us. If we agree, which we often do, we will provide that permission in writing. If we don’t want you to use it we won’t give permission. Simple. Yes?
However, let us reiterate it just so you are sure: UNLESS YOU HAVE PURCHASED AN IMAGE OR YOU HAVE OUR PERMISSION IN WRITING YOU ARE NOT AUTHORIZED TO USE IN ANY WAY OUR WRITTEN, PHOTOGRAPHIC OR OTHER CREATIVE WORKS. Such use is illegal.
Re-using our content and images and naming us as the source, providing a credit, or accompanied by a throwaway statement like ‘Courtesy of’ (this is even more offensive as it implies our approval) or similar statements are not acceptable to us. We explicitly do not grant any permission implied or otherwise other than in writing. If you do not have written permission from us and reproduce our work you are doing so illegally.
We couldn’t put it any clearer could we?
If you can’t do us the courtesy of either buying or making a formal request and choose to use our content without permission, we will assume you have chosen to ignore our legal rights and thereby accept the terms outlined below.
In re-using our content without permission you accept that it has a commercial value you will be invoiced via Spain Buddy at the following rates.
Text and articles will be invoiced at €1000 per item.
Images under the copyright notices of SpainBuddy.com (Spain Buddy), AlanGandy.photography (Alan Gandy), AlanGandy.com (Alan Gandy), SpainPhotography.net (Spain Photography) or AlmeriaPhotography.com (Almeria Photography).
Web and other Internet use will be invoiced at a minimum of €1000 per item (or more, as we see fit, depending on use).
Print, advertising and other media will be invoiced at a minimum of €3000 per item (or more, as we see fit, depending on use).
Applicable taxes and legal fees will also be applied in addition to invoice totals as appropriate.
The issuing of invoices is without prejudice and we reserve the right to pursue further legal action in accordance with any advice received from our lawyers.
In using our content without permission you are accepting these terms and agree to pay for such use at the rates described above. No communication will be entered into and failure to provide payment by return can result in legal action. We also reserve the right to ‘name and shame’ those individuals and companies who choose to flout the law, or to follow other forms legal action without any invoice or warning being issued should we choose to do so.
There are no grey areas on this. Capiche!
